Legal Question in Real Estate Law in Florida

Corrupt Attorney

My mother in law has been taken advantage of by allstate insurance and her attorney. She owns a house that she lost in a fire and was recommended a contractor from allstate that cashed her checks for materials for work that he did not perform. The lawyer that she hired apparently was representing her and the contractor the ripped her off. The lawyer advised her to sign a agreement not to sue the man that took advantage of her in order to receive a check that was due to her. At this point my mother in law has lost over a hundred thousand dollars and may lose her house as well. There is much more to this that is not in this e-mail. I would like to discuss this situation with someone that can give us direction with this matter. I can be reached at the information below. Thank you for your assistance in advance.

Re: Corrupt Attorney

An Attorney has an ethical obligation to decline to represent someone if he sees there is a conflict of interest that is detrimental to one of the parties. A waiver is only a waiver that there may be a conflict but it is OK for the Attorney to represent both parties and that should a conflict arise the Attorney must notify both parties and withdrawal representation from one of the parties. He cannot still represent both parties when there is a direct conflict.
