Legal Question in Real Estate Law in Florida

Cosigners on apartment lease agreements

We recently needed to terminate are lease do to a job loss and having to move. In the process we tried to get another apt. but due to our current apt. community they slandered us to the new place. Threatening and baggering us. My father co-signed for me and my fiance. He recently(two months ago filed for chapter 7), we were placed on the lease agreement as occupants only. The did require us to sign the lease but it states we are occupants and not lease holders. Since my father is protected under chapter 7 and we are noted as occupants are we bound by the lease, for example can they post anything to our credit legitimently.

Re: Cosigners on apartment lease agreements

There is no difference between occupants & leaseholders of the lease. If you signed the agreement you are bound by the terms. You are responsible for the rent until the landlord rerents. He must use reaonable efforts to try to rerent. Good luck.

If you signed it, then you are responsible under the lease.
