Legal Question in Real Estate Law in Florida

Date on contact

My husband and I signed a contact for Sale on our home. The agent told us we could have a 3 month contact he filled it out for 6 months. When he filled out the contact he also filled it out incorrectly. The Dates he filled it in with looks like this Sept. 2nd 2003 to Feb. 2nd 2002 and it should of been Feb.2nd 2004. Can we get out of the contact being the dates are not correct. This has been a agent from hell. Please help..

Re: Date on contact

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorneys individualized advice for you. By reading the Response to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

RESPONSE: Probably not on those grounds. Oviously you cannot have an end date prior to the start date. A court would be asked to construe the contract and intepret what the real intentions of the parties were. Since you admit it was supposed to be 2004 there really is no question. It is also readily apparent that the year had to be at a minimum 2004. However, consult a local attorney.

Good Luck,

Randall Gilbert
