How many days do you have to wait for rent before evicting due to non payment of

I have a tenant in my home since April 2000. I knew

her & did not require a deposit from her or last months rent. I trusted her. Anyway, since she had moved in she had not paid rent on time. She had been late every month by 15-20 days. She also to date has

not paid the full amount of the late fees? How many

days legally do I have to wait for non payment to start the eviction process? Does it matter that the tenant is unemployed? She was employed at the time of

the signing of the lease. I just need this one little

question answered please. We do plan on evicting. We just want to make sure we cover all avenues correctly.

How soon before can evict for non-payment of rent?

Three days unless you specified a longer time in your lease. Call or go to the courthouse and ask the clerk of the circuit court for a tenant eviction package. Several counties sell them for less than $10.00 This kit will have all the forms you need and will tell you how to fill them out.
