Legal Question in Real Estate Law in Florida

Death of Ex-spouse and home title

I am trying to get a second mortgage. My ex-wife died the day our divorce was final (within five hours after). The house would go to her if she was able to refinance in her own name. However, due to her untimely death, she did not obtain her own financing. The day of the divorce, the clerk of court removed my name due to the divorce decree. After her death, my name was put back and her name removed. A title search now shows her name on the title and I cannot obtain financing until her's is removed. Is there a simple way to accomplish this. We have a son together, whom I have custody. Thank you.

Re: Death of Ex-spouse and home title

Speak with your attorney. You need to clarify this issue with the court. The court decree may have to be amended.
