Legal Question in Real Estate Law in Florida

Deed as joint tenant with full rights...

I jointly own a small property, have deed; it is titled: ''... as joint tenant with full rights of survivorship and not as tenants in common''. Does this mean we own it 50/50 and can either of us sell our share without the others consent? if so, what's the procedure?

Re: Deed as joint tenant with full rights...

You own it 50/50 and either of you may sell your share without the other's consent. The procedure is to sign a deed deeding it to the buyer. Transferring the property will then terminate the right of survivorship, meaning that the share of either owner who dies becomes part of his/her estate, rather than passing to the other co-owner.
