Legal Question in Real Estate Law in Florida

Disclosing a death.

Is there any laws in the state of Florida, requiring the seller of a house for sale to disclose the death of a person in that house. If so, is there a time frame of when that so person had died. And do they have to disclose the cause of death, as in natual causes or suicide.

Hm. Sale & Death Disclosure

Q: Is there any law in the State of Florida, requiring the seller of a house to disclose the death of a person in that house? If so, is there a time frame of when that so person had died? Do they have to disclose the cause of death, as in natual causes or suicide?

A: There is case law in Fla. that requires disclosure of latent defects known to the seller. There is no Fla. case dealing with death or suicide. However, there are cases in other states that hold this to be a required disclosure especially where there was a suicide/homicide. There is no set time frame for when the death occurred.
