Legal Question in Real Estate Law in Florida
Disclosure responsibility of home inspectors and realtors
Are home inspectors responsible for failing to notify a buyer of a condition within a dwelling they are asked to inspect. In my instance, I paid for an inspection and was told the house was fine including the attic, but when I went to sell the property they found substantial fire damage from a major fire that I had to repair before selling. The inspector did not miss the fire damage, he lied on the inspection report and said the attic was satisfactory. The attic was not even close to being up to code. Do I have grounds for a suit against the home inspection company and inspector? Additionally, the realtor only listed that the bathroom fan caught fire and not that it was a major fire that destroyed the attic. She was the property manager of the property and knew the specifics but did not inform me. Do I have a suit against her?
