Legal Question in Real Estate Law in Florida

Divorcing - how to handle current joint lease?

My husband and I are divorcing and he's moving out. I wish to continue to occupy my residence here. We just signed a new 12 month lease. How does this effect me? Should I request to sign another lease? WIll that jeopardize my lease here? Another question, does this mean my ex H can have access rights to this house because his name is on the lease? Even though we've separated? No, no legal documentation as of yet.

Re: Divorcing - how to handle current joint lease?

This issue must be handled in the divorce decree. If you will be paying the entire rent then the lease should be in your name. If your ex will be contributing to the rent he should be paying you not the landlord.
