Legal Question in Real Estate Law in Florida

Domestic Abuse and Cancelling My lease

I've been in my apartment for 5 months and have 7 months left. I live with my boyfriend whos not on the lease. He abuses me and police come but he's always gone so he never gets arrested. I want to move back home, and don't want to ruin my renters history, due to circumstances. If possible, could I get the security deposit back, and what needs to be said or done to end lease?

Re: Domestic Abuse and Cancelling My lease

Residential leases generally do not have a domestic violence escape clause that would allow you to terminate the lease because your boyfriend is threatening or hurting you. Meet with your landlord to explain your plight and perhaps you can reach a settlement with him/her. If your boyfriend is a party to the lease, maybe the landlord will look to him to collect rent. Good luck.

Re: Domestic Abuse and Cancelling My lease

Unless your landlord is understanding and lets you out of the lease your situation is not legal grounds to break the lease.
