Legal Question in Real Estate Law in Florida

downpayment on a home

back in 1997, my sister and myself built a duplex together. The mortgage is in my sister and her husband's name, however, the down payment on the property was supplied by just my husband and myself. now we would like to build something of our own, and are looking to get back the money for the down payment from my sister and her husband. We put down on the duplex 16,000.00 and would like to know if we have any legal recourse to recapturing this money. We have no legal documents to show the down payment, but do have bank records to show the money going to my sister for the house. What are our options, if any? please advise. thank you.

Re: downpayment on a home

An attorney would need to review the documents.

For example, you did not mention whose names

were on the deed. From the information you\giave,

it appears you may have a cause of action

against your sister for reimbursement. However,

an attorney would need to know have a lot

more information. Even then, he or she would

only be able to express an opinion as your

sister may have a different version of the facts.

I strongly suggest you seek the advice of

an attorney in your area who is experience

in real estate law.
