Legal Question in Real Estate Law in Florida
Early Lease Termination
My husband applied for a job transfer to another state several months back and it has just now come through. We signed a short term lease in anticipation of being transferred but had no way of knowing or controlling the timing of this event. We have 4 months left on the lease. There is an early lease termination fee of $1100. They did offer to transfer us to one of their other complexes in the state where we will be moving to and all deposits would transfer. But we would have to sign a year's lease. We did some checking to this site. There complex is approximately 35 miles from the new job site and not in the City we desire to go to.
As a side note, there are a lot of vacancies in this complext we live in right now. The complex is owned or managed by a company named United Dominion.
I hope I have supplied enough detail. It is not our desire to try and "get out" of our responsibility, but $1100 does pose a hardship with the other moving expenses we will have. Thank you for your time.

Early Lease Termination Fee vs. Breach
Facts: Applied for job transfer to another state several months back and it has come through. Signed a short term lease but have 4 months left on the lease. Early lease termination fee is $1,100. Complex offered to transfer deposit to one of their other complexes in the state where will be moving. But required to sign a year's lease. Complex is approximately 35 miles from new job site and not in desired City. It is not intent to try and "get out" of responsibility, but $1,100 does pose a hardship.
Q. What do we do?
A. Try to sublease your unit; failing that try to negotiate a lower escape amount; failing that your choice is to either pay or wait to be sued or have your credit blackened.
