Legal Question in Real Estate Law in Florida
Equity Line of Credit
If a person pulled a home equity line of credit on a home they didn't own, can they plead it wasn't done illegally because the original homeowner ''approved'' of the transaction, even though the original homeowner did not sign for the property?

Re: Equity Line of Credit
You can plead anything you like. The facts, however, will speak for themselves. In this case it sounds as if you created a lien on someone's property for the sole purpose of obtaining loan proceeds without having the obligation of paying the money back. That sounds a lot like theft. Permission after the fact is not a defense to that crime. Good luck to you.
