How can I evict my tenants ?
My tenants have broken the lease on numerous occassions by numerous ways. Both sign the lease, one has moved out and another person moved in. They donot maintain the grounds. They are always late with the rent and deduct for expenses that according to the lease they are responsible for. The lease states non-smokers but they smoke inside the property. I am unable to get a fixed time to have a plumber enter the home to fix a leak and now they will wrote to advise me they will deduct $100 from the rent due to this unfixed problem. Help!!

The procedures are outlined in Part II, Chapter 83
of the Florida Statutes and the rules of civil procedure.
There is a requirement to send a three day notice if
your basis for evicting is nonpayment and a seven
day notice if your basis is for breaching some other
term of the lease. If the matter is not corrected
within those time frames, you can then proceed with
the eviction proceeding through court. Don't try
any self=help remedies or short cuts. You will make
yourself liable for wrongful eviction or may be violaitng
some Florida law. You can represent yourself, but
I do suggest you retain an attorney.
