Legal Question in Real Estate Law in Florida
eviction of Apartment
My son has been issued an eviction notice. They are to be out of the apt. complex in 5 days. There are also repair issues that have not been met. They would like to stay. Can they make the payment for the month even with repairs still pending, and can the landlord allow them to stay even if the eviction notice has been filed in the clerks office? There have been many conflicting answers with the property manager. Is a plumbing problem, stopped up bathtub and a kitchen sink that fills up when water is draining in the bath, a reason to withhold the rent? Thank you

Re: eviction of Apartment
Chapter 83 of the Florida Statutes has the procedure to follow in this situation. Pay the rent into court.
