Legal Question in Real Estate Law in Florida

Eviction

I had co-signed for an apartment for my 18 year old son. The lease was for 6 months. I got the apartment for him in December, which means the lease would be up in June. He had gotten evicted in the beginning of April. Which left two months. Am I entitled to pay the rest of the rent for the two months he is not living there?

Seeing that I had co-signed, is my credit going to be bad and will the landlord put a lein on my house?

Thank you,

~ Tina

Re: Eviction

It would depend on why he was evicted. It would also depend on whether the apartment was rerented. You may have a number of defenses if the landlord sues you. Your credit is not effected at the present time. Speak with an attorney.

Re: Eviction

You may have a number of defenses depending on the facts and circumstances surrounding the eviction and the terms and conditions of the lease. Unless the landlord files a lawsuit and obtains a judgment against you, no lien can be placed against any of your assets. Your credit is probably fine at this point. If you receive a demand letter or get sued, seek the advice of a lawyer.
