Q. How long does it take for a homeowner to legally evict renters with a verbal agreement? How long does it take to physically move the renters out after that?

A. It depends on how quickly you can deliver the proper notice and whether or not the renters fight you or file papers with the Fla. court. Generally, if they are behind in rent and you deliver a Three Day Notice; then immediately file suit when the three days are up; the court is required to expidite the trial/mediation, and you should be in court within two weeks. It really depends on the court's caseload and the mediators schedule. I anticipate three to four weeks where I practice.

As to your second question, you get a Writ of Possession and file it with the Sheriff; the day after you give it to the Sheriff, they deliver or posts the Writ on the property and comes back in 24 hrs. with helpers to move their belongings to the sidewalk. This assumes you pay the sheriff's fees and charges to hire the movers.
