two persons signed the lease on over 65 and the other under 65 the one over 65 died now the one under 65 is being evicted nothing in the lease state anything about age.

Age does not play a role in eviction. Landlord can only evict if the tenant has breached the lease agreement, or stayed over the term of their tenancy.
