Eviction of a tenant from my home
I moved from Mass. in May 2001 with my boyfriend of 1 year than. I had sold my home in Mass. and purchased another home in Florida with my own money and only my name on the deed. I had a verbal agreement that my boyfriend would be allowed to live there for $100 a week to include all utilities and food. I wish to have him move, but he refuses. The police informed me that he has to be evicted. Unless he causes me harm I am unable to have him removed from my home. When I called my local court house, they informed me that I need an attorey because the normal landlord, tenant rules would not apply. What can I do from this point to have him evicted?

You are considered a "landlord" as you are allowing antother to occupy your hom under a rental agreement; even if he dosent pay.Go to your county courthouse and ask the clerk in the landlord-tenant office for a form called "3 day notice." They will give you instructions.See Florida Statutes Chap 83. If he reads your emails;Bubba: be advised that you can move now on your own, or the sheriff will remove you...and he wont wait while you load up.

It appears you had a verbal, month-to-month tenancy. Given your tenant's disposition, you may have to serve him with a notice of termination of tenancy and then file an eviction action seeking a final judgment for possession to have him removed by the Sheriff of the county where the property is located. Seek the advice of counsel and good luck.
