Legal Question in Real Estate Law in Florida

Me and my exboyfriedn had an apt together and on our last month of the 1yr contract we decided to leave but we didnt pay our last months rent and didnt tell them that we were leaving. Well since we didnt pay they sent me a letter from the credit union and i have been paying it.. But its under my name and my ex's name.. so what i wanted to know was if i could sue him for half of that. But we live in 2 different states..

And i also have a power bill fromt hat apt but its under my name only but it was our appartment so i alsoo wanted to know if i could sue him for half of that?

You can sue. But, did you try to ask him for the money? What you should do is write a letter, itemize exactly what is jointly owed, ask that he send the money to you by a certain date or make payment arrangements, attach bills or proof of the money owed, and send it all certified mail return receipt requested. If he fails to contact you regarding payment, or he says "no" he won't pay, then you can sue in small claims court in the county where the property you resided in was located.

It costs money to file a lawsuit, so you are better off asking him for half in writing to start. Depending on the amount of your claim, you can probably file suit against him for what he owes you in small claims court. The clerk of court for your county will have forms, and you will need to keep copies of the lease, letters and bills as proof of what he owes. Regards,
