Legal Question in Real Estate Law in Florida

family member

My step son retuned home from college for spring break. he stated that he was only going to be here a couple of weeks and then he would be leaving. I do not want him in my house because he has decide not to return to college. I do not have a landlord tenant agreement, so would I have to start eviction proceedings to have him removed from the house?

You are correct, if your stepson refuses to leave your home, you would have to file an eviction action to oust him. However, without knowing your relationship with your stepson, you may want to consider having a conversation with him regarding your concerns and wishes before you run to the courthouse to file suit against a family member that resides with you. Just a thought. Sometimes having a frank discussion with the person with whom you have a dispute actually leads to the resolution of problems like the one identified in your e-mail. Good luck.
