Legal Question in Real Estate Law in Florida

where to file?

I rented a house in Florida.The landlord lives in New York.I now live in New Jersey.I never received my security back and never got a notice why.This has been since March.I know the landlord only had 15 days to notify me one way or the other.What I would like to know,is what state do I sue the landlord in? Would I have to go there in person or could I have a proxy represent me? Also,would I be entitled to more than she owes or the exact amount of the deposit. Since she did not follow the law,would she be able to fight the lawsuit?If you could answer it would be greatly appreciated.

Re: where to file?

You may file in Florida, where the property is and where the transaction which gave rise to your claim is located, or in New York where the proposed defendant is located. You can recover the full amount of the security deposit plus costs and attorney fees. If trial is necessary chances are that your physical presence will be required.
