Legal Question in Real Estate Law in Florida
I filed a bankruptcy in Jan 2008 and discharged in May of 08. Included in my debt was a mortgage on a home. The mortgage lender filed a lis pend. but never forclosed on the property. Now the home is still in my name and I can not buy a new home. How do I get the home out of my name? Or what can I do with the home?

My assumption is that the house debt was not really included in your discharge. Doing so would not be common as it is a secured debt. You probably still own the house. Put it up for sale - short sale - and try to get rid of it that way. However, if there is a lis pendens, your lender has probably filed for foreclosure - But really, from the facts you provided, I cannot say what is happening or give proper advice.
