Legal Question in Real Estate Law in Florida
filing a quit claim deed
We would like to remove our name from the deed and add our eldest son's name so he will be able to claim homestead exemption here in Florida. Where do I file the deed after it has been signed & notarized?

A Quit Claim Deed should be filed with the clerk of the court's recording office in the county in which the property is located. It can be mailed to the court together with a check for documentary stamps on the deed (either 60 cents or 70 cents per hundred dollars of the amount of the transfer) together with a Return for Transfer of Real Property (DR 319) which can be found
online at:

Information on the documentary stamp taxes can be found at:

You would be wise to consult an attorney and have the attorney prepare the deed for you. If you make an error, it can be extremely costly to correct.
