Legal Question in Real Estate Law in Florida
Florida Life Estate
My husband and I purchased my mother's farm in Nov of 2004 for $100,000 cash. In this transaction we agreed to give her a life estate.
Our question is this, can we now sell the home so long as the buyer agrees to maintain the life estate? Could my mother block such a sale? Does she have to agree to such a sale?
Thanks,
Margaret

Re: Florida Life Estate
Your mother should be on the deed, with the words, life estate. As such she would need to consent to any sale and sign any documents just like any other title owner.

Re: Florida Life Estate
Your mother or her representative can block the sale. Any new buyer will require a title search which will show her claim.
