The proper legal action is a suit for partition wherein you ask the court to force the sale of the property and the proceeds divided in proportionate shares. Generally, a court will allow the parties to have the opportunity to make a deal among themselves or sell the property with an agreed real estate firm. If they parties cannot agree or a sale is not possible, then it will eventually be sold at a forced sale by auction.
