Legal Question in Real Estate Law in Florida

Foreclosure agian...

Hi, I was in foreclosure for 3 1/2yrs. we won our case and we waited for our payment book. it came around the end of April, and our first coupon started for May 1st.2004, so I sent the full amount in, we recieved back stating that the M.O. was not for the full amount which it was. they now are saying we owe them from Feb.2004, but we didn't recieve anything until the end of april, and then we started with May,2004 of our coupon book. about 2wks.ago I was served with foreclosure papers AGAIN, what can i do? what are my rights? this has literally torn my family apart, my husband and I are currently seperated due to the first foreclosure that took 31/2yrs. of our lives, our children are very upset AGAIN and are scared. Me, personally i'm just over it!! please i need help and i have very little money so i can't get a lawyer, so i'm on my own AGAIN and i can't go thru this AGAIN. PLEASE any advice or help would be such a blessing to myself and my children. Thank-you for your time, Angie and kids

Re: Foreclosure agian...

You need to file papers formally with the court requesting what amount is due to bring you out of foreclosure proceedings. Visit your local law library it should be at a your county courthouse, the librarians there are very helpful and can show you how to do research on foreclosure and where to get forms. Also, do some background on this mortgage company, they may have a history of doing this to people, if so you can follow the steps of others who have ventured before you and bring this to the knowledge of the Judge in your case. Look up other foreclosure proceedings that have this mortgage company listed at the local courthouse or online (if your county courthouse has case histories listed online) Make sure this mortgage company dotted all of there "i's" and crossed their "t's" when proceeding with this foreclosure action against you.
