Legal Question in Real Estate Law in Florida

Foreclosure of Disabled Person

A disabled person (40) has a FHA mortgage on their home and had a forebearance agreement (expired 1 yr. ago) due to the disability, but the loan was sold to a private bank. Payments were made to the bank in a timely manner until an auto accident. The person receives SS disability and child support but is two mo's late on payments. Can the bank foreclose? Also, can the bank give the person time to sell the home?

Re: Foreclosure of Disabled Person

The bank can foreclose. Further the bank can make any deal with you. Therefore you or your repesentative should sit down with an authorized bank officer to discuss the best way to resolve your problems. There may be other avenues for relief available. Your question does not give suffucient details to explore the matter past the direct question. If you are in this area and desire a consultation, call me ay 305-940-8080.
