Legal Question in Real Estate Law in Florida
Foreclosure
A friend of mine has been paying for his mortgage however, it was sold from the place that he got it from and was never notified by the new or the old company. He was paying the old company every month and they were keeping the checks ( he says he has the last 6mo carbon copy of). From what I understand the new company has evicted him and he and his family has to be out Sunday. The old company has gone bankrupt and refuses to talk to him about the problem. He really is in need of help.

Re: Foreclosure
Something doesn't sound right about the story. For the new company to "evict" him, or foreclose of the mortgage, he would have been served with a complaint and notified of court appearances. That was when your friend should have produced his carbon copies of checks paid as his defense.
If the foreclosure is final and and your friend has to be out todayas you say, then unfortunately it sounds like he may have waited too long to seek advice of counsel.
