my soon to be ex purchased a home with me as a cosigner..i also signed a waiver as to any rights on the propery, she is in forclosure, i got served because they could not locate her, the mortgage is in her name only, can i be held responsible for the mortgage?

It all depends on who signed the note. If you did not sign the note, then you are not responsible for the debt. Its likely you got served because if your name is on title with your ex (wife?) and if the house was homesteaded, then you have certain property rights (not withstanding the waiver).
