Legal Question in Real Estate Law in Florida
foreclosure rules
My husband and I are 2 payments behind in our mortgage and are trying to catch up but it may be a few months before we can do so. We do make a payment every month but have 2 backed up. Can the bank foreclose on us even if we are still making payments but are behind on the 2?

Yes, legally they can but generally they won't. Simply mailing the payments on your own schedule is not correct, however. You should call the lender and speak with them. Most lenders have a special department to work with borrowers who are a few months behind to help them catch up by working out a repayment schedule that both parties can agree to.
