Form for removing a name from deed?

Hello,

My husband and I are filing for divorce, but our house contains 4 names, ours and my parents. We want to remove his name from the house before we file for divorce because we think it will simplify the divorce settlement. Which form should we use and where do we get it?

What you need is a Quit Claim Deed. The form can be found in most office supply or stationery stores.

I wish to caution you that it must be filled out completely and accurately otherwise you will not accomplish your goal. It is well worth the investment to retain an attorney to draft this instrument for you to make sure it is done right. Most real estate attorneys will draft a Quit Claim Deed for a very reasonable fee. The attorney will also draft a Return for Transfer of Real Property which is required to record the deed and will be able to advise you on issues regarding documentary stamps required to be paid to the State in order to transfer the title.
