Legal Question in Real Estate Law in Florida
I found online ad for Property Management , I asked them to rent my property, we agreed the first month rent as fee, then $79 per month. I provided the Home warranty information to Mike, who is the Manager at that time. Next month I did receive the statement that they repaired something with out using the Home warranty and the whole rent is taken for that . I called them and they informed Mike is no longer with them. So I worked with Jen and provided the same to her. Next month again I received the statement and the whole rent again taken for repairs. I called Jen and asked her about it. By the time I did receive HOA notice for the rust in the drive way. I sent email to Jen and told her that this is the last notice and I need to clean this to avoid the legal notice. So I sent one company to clean and took all the pictures and ask Jen that the renters should pay for this, as they did that. She agreed, Guess what next month they sent notice saying they paid for cleaning the rust. I called now Jen is no longer with them, Lisa is the new manager. I sent all the details and she told she will research and get back to me. Today I asked for the status, the email came saying she is no longer with that company. I know this is fraud and I need to sue them, so that they can't do this anymore. I have email ,call history and Pics to prove
Please advice how to sue them
1 Answer from Attorneys
Do you have a copy of your original agreement with the Property Management company? Is there an attorney's fee provision. If so, you should have no trouble locating an attorney to represent you. There may be several ways which you could sue them depending on what documents you have. The bigger question is if they are collectible.
