Legal Question in Real Estate Law in Florida

Fraudulent Real Estate Purchase, POA

While on active duty in Iraq in the Marine Corp last year, my estranged wife left our aprtment in California, moved to Florida and bought a house without my knowledge. She used me as the co-borrower for income purposes as she does not work. I have never been to Florida or seen the house. I never signed a single document on this transaction. When I contacted the Title Company and lender involved they both told me that she had a POA for me. Neither the the Title Company or lender has a copy. (THERE NEVER WAS ONE.) The title company has sent me there entire file on the transaction and my ex signed the documents with either just my name or her name then followed by POA and my name.

Subsequently she now is late on the loan and it is effecting my credit now.

The title companies response was ''gee, we are sorry!'' What can I do? I just spent 14 months in Kuwait and Iraq to find out that my bank accounts were cleaned out and fraud has been commited against me.

Wouldnt the lender and Title Company be somewhat responsible???

Thank you!

Yes. You may have to bring legal proceedings in Florida to clear up all the records.
