Legal Question in Real Estate Law in Florida

Right to have full access to my property

My ex-partner and I both own a house together and we both live there together with his father who does not pay rent yet. Just recently he changed the locks and does not grant me any access to the house any more. The police told me there is nothing I can do about it because this is a civil matter and they can't force my ex-partner or his dad to let me back into the house.

what are my rights? is there a way to force one or both of them to pay me rent for using my property while they deny me access to it? do I have any other options other than forcing the sale of the house?

Re: Right to have full access to my property

you can bring a partition action and have the property sold. When the proceeds from the sale are divided you get a credit for back rent or for use of the home from the other co-owner.

Re: Right to have full access to my property

Since he is there with an owners permission you cannot evict. Your remedy is a partition action to sell the property.
