Gate in fence

We are building a house that has an existing wood fence on the back of

the property, built by the developer on the other side of the fence. We

asked if we could put a gate in the fence that opens out onto a street

behind. He declined. A portion of that fence encroaches 6'' on our

property and runs along the property line for the remainder. What are

our legal options? Can we install a gate in the portion of fence on our

property? Can we make him move or remove that portion of fence?

Re: Gate in fence

Check your contract,deed,survey and title policy. If his fence is encroaching on your property and he refuses to remove it you may need court intervention.
