Legal Question in Real Estate Law in Florida

Hello,

My wife and I have recently bought a home about 1 year ago in a community called Belmont in Florida. The builder there is Beazer. When we bought the house we did not know that the community has gone into foreclosure. Shortly after we moved in, Beazer moved out. Now, Beazer still had there layout and plans with this community on display while we were buying the house. They had signs and everything showing that they were going to build a school, park, swimming pool, etc... We moved in with the idea that this was going to be a great neighborhood very shortly. However they were already in foreclosure and did not tell us this. Obviously I am not happy and would like to know if there is anything I can do?

Mr. Watson. First, I'm very sorry. There are many people out there who are trying to buy properties and finding out they "Bought a lawsuit" instead. Second, this is too complicated for the Internet. I believe you want to rescind (void) the contract like this never happened. Whether you want some money back because you were misled or whether you want all your money back because you were misled, you have to hire a attorney ASAP. You cannot piecemeal this and do a little research here and there, ask a few attorneys here and there; ask a few friends here and there (esp. non-attorneys). Frankly, this would be too complicated for me. I would have to do a lot of research to handle this and phone other attorneys for advice. I'm trying to make a little money and help people in foreclosure, this is another animal all together. You have to act fast because Beazer probably owes a lot of money to a lot of people. Of course you will hear, "Well, you signed the contract." It is not that simple. Just because someone signs a contract, does not mean your case is hopeless. If that were true there would not be so many contract lawsuits. This is going to cost you some money to fix. You should be able to find several attorney who will give you quotes and talk to you for a free first consultation.
