Legal Question in Real Estate Law in Florida

Hi,
I live in broward county Florida. I purchased my home in 2009 and since then, the neighbor behind me has put up a fence. Recently, I began getting quotes for a fence and have been told by the companies giving me quotes that the neighbor has their fence about a foot on my yard. They pointed out on my survey as well how far back they should be able to fence and can't because of the neighbor's fence. I was not concerned when they put the fence up because our HOA requires you to pull a permit and I thought they would not pass inspection if thee put the fence on my yard. I am being told that is not how it works. What to I do to get my yard space back?

He is trespassing. Have him remove the fence. If he refuses, bring a lawsuit.

Notify the neighbor and provide him a copy of the survey. Hopefully it resolves without a lawsuit which would be expensive.
