Legal Question in Real Estate Law in Florida
Hi,
we're renting our apartment 7 years never late never late with our rent and our credit rate is the highest over 800 (we are retired people).
2 days before our lease renewal was due owner agent informed us either pay $400.00 more/month or no extending lease, but our check was cashed for that month even that we have $ 4200.00 deposit 1st month, last month and 1 month security.
The bldg. requests minimum 6 month and 1 day lease for all residents or else everything will shot off electronically with expired lease.
Can't talk to owner or owners only agent and it's very difficult, but we want to ask, if we can file a civil suit against this people?
we will move off course, but this is BLACKMAIL or worse!!!!!!
please advise....

They have right to raise rent. You have right to return of security if apartment not damaged.
Your current lease would control the ability to raise or not raise rental if it discusses that. If not, they can raise rental to whatever amount they want. if you paid the current month and they accepted that payment they cannot raise rental until the next month. without a continuation of the current lease or a new signed lease, you are on a month to month rental.
