Legal Question in Real Estate Law in Florida
My HOA in Florida refuses to take care of a problem which is their responsibility/
What recourse do I have?
1 Answer from Attorneys
If you are sure it is their responsibility, then you write a letter and send certified mail, registered mail, return receipt, UPS, DHL, Fed Ex whatever, you need proof that YOU HAVE PUT THEM ON NOTICE. Your phone calls to them are not admissible. Hearsay. Then see if they do anything. If you have done all this and they still refuse. I don't know what they have done or not done, but you have to sue them. I don't know problem, so I don't know which court to tell you to go to, but I would hire a attorney because HOA have attorneys on retainer year round. Who get paid to sit around and do nothing. Hell the probably have a attorney on their board of directors. I hate HOA's.
