Legal Question in Real Estate Law in Florida
New Home Builder
Can a new home builder in the state of florida sell a house the same as yours for less money. We cannot refinance now, because builder brought down the value of our house by 70k. Is that legal? We bought Nov. 2006 and months later builder sold same house for less due to market. Please check Florida laws.

That happened to my client, and I was able to renegotiate a new price. I always advise my clients to provide for such a condition, in their contract when purchasing a new home from a developer. Didn't your attorney do so?

A developer can sell a property for more or less as he/she/it chooses. The market place will dictate the final price.
The market in Florida has had a downturn in many areas and the new price may reflect the accurate value based on market conditions.
If you bought in November, 2006, it is improbable that you would find more favorable rates for a loan now then you did at closing. You may have to wait until you gain some equity in the property or the market swings back up.
