Legal Question in Real Estate Law in Florida

new home contract

I signed a few weeks ago a new home contract. In the course of going through all the choices that have to be made for a new home construction, i came across a paper that had my husband's and my signature which we never signed. The signatures were taken from another paper and copied unto that paper. Now that paper was not such a big deal because it delt with choosing the location of phone & cable outlets, but when i compared it with the original that i had, the decorating person in charge had doctored the document, which may i add was all wrong and pasted our signatures in an area different from where we had signed the originals. I am truly astonished and fearfull of the future with this company. Now they are calling me relentlessly wanting me to finalize on paperwork since this incident. Something is up. Do i have grounds to break my contract with them because i don't want to work with them anymore. It is illegal what they did right? Even though the paper may seem insignificant. Please let me know my rights. By the way we signed the purchase contract on 4/23/07 with a deposite of $7,500 and the seller signed on 4/24/07.

Thank you.

Re: new home contract

Breaking contracts, especially new home contracts is always a difficult matter, especially in this market. Although it may seem very apparent to you that this signature was altered, it is oftentimes difficult to prove. The opposing party may feel that you are simply looking for a way to get out of it and may have constructed this matter. Having said that, if it is very clear to you that this was done and if perhaps you have some other proof that this wrong was committed, you would stand a fairly good chance of rescinding the contract based on fraud or misrepresentation. I would be happy to review the documents for you to see what I think your chances of challenging the entire contract based on those grounds.
