Home equity loan without other owner's knowledge

Is it legal in the State of Florida for a person to take out a home equity loan on a house that is owned by that person and another, without the second person being aware of it? My partner's former girlfriend, who he purchased a house with several years ago, apparently took out a home equity loan on the house recently, has not made payments, and now it appears that we are going to lose the house through foreclosure. The final hearing was today, and we were made aware of it after the hearing was over. Should we contact an attorney, or is it too late already?
