Legal Question in Real Estate Law in Florida

A home owners assocaition is forming a renters committee

Our home owners assciation is forming a renters committee. The committee will be made up of residents of the assciation. purpose of the committee is to review the prospective renters for any landladies/lords. The question is can the committee have any control over who may sit on the committee? We want to limit the number of landladies/lords and renters who can sit on the committee.

Renters' Committee

To my knowledge there are no Florida statutesgoverning who can serve on committees. Your nextauthority is the deed restrictions, then thethe articles of incorporation. I would doubt that either of these place restrictions on whocan serve on the committee. The next document toexamine is the bylaws. Here you might find someprovision stating that the requirements areto serve on a committee. Of course these couldbe amended to place any restrictions you want to place. In short, unless there is some provisionin any of the above mentioned documents, thecommittee has the latitude to decide how themembership is determined.
