home purchase

i purchased a home 3 years ago. basically the central heater has never really worked. we are now looking into replacing the unit. my question is: do i have a claim against the former owner--since it never worked? and if so, should i wait to settle the claim before replacing the unit? we have no heat at the moment and would like to replace the unit.
