Legal Question in Real Estate Law in Florida

This is my home.

I recently inherited a house where the last owner has a lease with the current tenants that expires in June. As the new owner am I obligated to honor the lease? We spoke to them in October of last year about the changes. If I do have to honor the lease,is there any way around thi situation? I really would like to move in. Please help.

Facts: Inherited a house with a lease that expires in June. Spoke to tenants in October about the changes.

Q. Am I obligated to honor the lease?

A. I agree with atty.Randall Reder that you are probably bound to honor the lease. Had you bought the property, it would be a different story. You could have made the seller be responsible and refused to take over the lease. However, since you inherited the property, I believe you got what was left to you, property encumbered by a lease.

Yes, you have to honor the lease unless the

tenants have materially breached the lease

agreement. Even then there are certain procedures

you have to follow. You and the tenants can of

course enter into a new agreement. You may want

to offer to pay them something to leave early.
