Legal Question in Real Estate Law in Florida

homebuying w/ tenents already there

I am buying a house and the owner is afraid to ask the tenants to leave because they are from pakistan. she has asked me to ask them to leave after the house is in my name. i ahve already went to the woman* and have informed her that i wanted the house the moment i signed for it. she has told me that she is not going to leave until 7/31/2002. the owner gave her a letter a month ago telling her that the property would be sold and it has to be vacant when the new owners take over but she still has not done anything to move, as of yet. i will taking possesoion of the property next week. how do i get her out and how long will it take. i am willing to pay an attorney for his services to get her out. i am a single parent w/ 5 kids and i need the place for myself and my kids. i also explained to her last 4/11 that if she were to stay there would be a drastic increase in the rent in order to accommadate me and my kids. she told me that she would not pay anymore than 1200.00 a month which is not even what my mortgage will be. what can i do?

Re: homebuying w/ tenents already there

You purchased the home subject to the tenant. You cannot legally remove her until her lease expires. Your contract should have required the owner remove the tenant or reduce the purchase price. You should have had an attorney review the contract of sale. You may call me if you need any further infomation. Phone # 561 998 9401. Good luck.
