Legal Question in Real Estate Law in Florida

Homeowner Association Renters

I have a property in which I do not live in, but my daughter and her family live there.

The Homeowners Association considers my daughter to be a renter. They require

a $500 security deposit as well as $100 for a background check. I know there has been problems in the past with some renters, but I do not think I should pay because

it is an immediate family member. There lawyer has said since I do not live there, and they are not the owners, they are considered to be renters, reguardless if they pay rent or not.

Re: Homeowner Association Renters

It is probably cheaper to pay the $600.00 than to retain counsel and try the case. The HOA can define the word 'renter' and apply it evenly to all unit owners. Check the by-laws and rules.
