Legal Question in Real Estate Law in Florida

my homeowners assn. check was returned.

I sent my homeowner's association money in the return envelope provided. I sent it regestered, return reciept requested. 30 days (approximatly) later, the envelope was returned as un claimed!

My question is, do I owe this money still or by the

action of the property management co. in not claiming

the money, do I no longer have an obligation to pay!?

I also received a threatning letter of legal actions

because the property management co. had not received

my payment!?

Re: my homeowners assn. check was returned.

You still owe the money. However, if you sent the payment by certified mail in a timely fashion, then you should not be assessed any late fee or other penalties since it appears to be the property manager's fault that the payment was not received as it was returned unclaimed. Write to the sender of the threatening letter regarding the matter and include a copy of the certificate showing the correspondence was unclaimed. Good luck.
