Are Homeowners required to be members of a Homeowners Associations

Moved into our new home in 1996. It's a new development, when we closed, we were never informed of a Homeowners Association. Three years later, developer sends a letter to all homeowners stating he was turning the Homeowners Association over to the residents. The Property Management Company the developer hired to attend the turn over meeting said we have no choice and must be part of the association. A few facts that may help you in answering my question: Approx. 150 homes in devlopment, about 75% completed. Have two Retention Ponds. Dues are $180.00 per year. Coventents and Restrictions were filed at the Court House when we moved in, however, we knew nothing about them. Must I be part of this association? Need more info.? Contact me. Any documents recorded at the courthouse are public notice of their contents. When you closed on the property you should have purchased a title insurance policy. There's probably some reference to the HOA in there. Usually a HOA is a good thing to keep your propery values and avoid unsightliness in your neighborhood. JMC
